1. INTRODUCTION

1.1. Welcome to Bizfly Cloud operated by VCCorp Joint Stock Company and its affiliates (“We” or “Bizfly Cloud”)

Bizfly Cloud hereby notifies you and requires your consent and permission to process, collect and store your data for the purpose of providing services to you throughout your use of our services.

Bizfly Cloud takes its responsibilities seriously regarding information security in accordance with Vietnamese law regulations on personal data protection and commits to respecting the privacy and concerns of all users regarding our website/mobile application/software (“Platform”) and the services we provide.

Users means persons who register accounts/provide information to us to use the services.

We recognize the importance of the personal data that you have entrusted to us and believe that we have the responsibility to properly manage, protect and process your personal data. This privacy policy (“Privacy Policy” or “Policy”) is designed to help you understand how we collect, use, disclose or process personal data that you have provided to us, whether now or in the future, as well as to help you make informed decisions before providing us with any of your personal data.

1.2. “Personal Data” or “personal information” means data about an individual through which their identity can be determined, or from that data and other information that an organization has or is likely to have access to. The data includes but is not limited to information containing name, age, date of birth, ID or Citizen ID, phone number, address, email, etc.

1.3. By using the services, registering an account/providing your information to us means that: you confirm and agree that you accept the methods, requirements and policies described in this privacy policy. You hereby acknowledge that you are fully aware of and agree entirely to allow us to collect, use, disclose and/or process your personal data as described in this policy. If you do not agree to allow the processing of your personal data as described in this policy, please do not use our services or access our platform. If we change our privacy policy, we will notify you through posting those changes or the revised privacy policy on our platform. To the extent permitted by law, your continued access to, use, exploitation of the services or platform is deemed to be your acknowledgment and agreement to changes in this Privacy Policy.

1.4. This policy applies together with other notices, policies or contractual terms, consent terms that apply in relation to our collection, storage, use, disclosure or processing of your personal data and is not intended to override those notices or terms unless we state otherwise.

2. WHEN WILL BIZFLY CLOUD COLLECT PERSONAL DATA?

2.1. We will/may collect personal data about you:

When you register and/or use our Services/Platform, or open an account with us;
When you submit any forms, including but not limited to application forms or other forms relating to any of our products and Services/Platform, whether online or in other form;
When you enter into any agreement or provide other documentation or information in respect of your interactions with us, or when you use our products and services;
When you interact with us, such as through telephone calls (which may be recorded), letters, fax, face-to-face meetings, social media applications and emails or any other form;
When you use our services, or interact with us via our Platform. This includes through cookies that we may deploy when you interact with our Platform;
When you grant permissions on your device to share information with our Service/Platform;
When you link your Bizfly Cloud account with your social network account or other external accounts or use other social network features, in accordance with the providers’ policies;
When you carry out transactions through our Service/Platform or provide information to us to use services or request support;
When you provide feedback or submit complaints to us;
When you register for a contest, program, event;
When you submit your personal data to us for any reason;
When you perform other activities in relation to our Service/Platform.

The above instances are not meant to be exhaustive and only represent some common instances of when your personal data may be collected.

2.2. We may collect your information from you, our affiliates, third parties and from other sources, including but not limited to business partners (such as shipping service providers, payment providers, solution providers, technical infrastructure providers, technology, communications, etc.), credit assessment agencies, marketing service providers, referral providers, loyalty programs, other users using our Services/Platform or other publicly available data sources or state data sources…

2.3. In some cases, you may provide personal data of other individuals to us (such as your family members, friends or people in your contact list). If you provide us with their personal data, you represent and warrant that you have obtained their consent to process their personal data in accordance with this policy.

3. WHAT DATA WILL BIZFLY CLOUD COLLECT?

3.1. Unless otherwise specified in this policy, personal data that Bizfly Cloud may collect includes basic personal data and sensitive personal data, which may be part or all of the information listed below:

Full name, middle name and birth name, other names (if any)
Email address;
Date, month, year of birth;
Gender
Residence information (Including: residential address, temporary residence, hometown, billing and/or delivery address;…)
Bank account and payment information
Phone number; citizen ID number
Information sent by or related to device(s) used to access our Services/Platform;
Any data, information that you actively provide through our platform during service use.
Your voice through recorded calls when you communicate with our staff (if any);
Images or audio or video. Identity information issued by government or other information for legal assessment purposes, customer identification, information verification and/or our fraud prevention;
Communication data, such as your preferences for receiving advertising information from us or third parties, communication method preferences and history of communications with us, our service providers, and other third parties;
Usage information including details about your search history, transactions, advertising and content displayed that interact with the Service/Platform, as well as your related products and services;
Any other information about users when users log in to use our Service/Platform, and when users use the Service/Platform, as well as information about how users use our Services or websites/mobile applications; and aggregate data about content users use.

The above instances are not meant to be exhaustive and only represent some common instances of your personal data that may be collected.

3.2. The information you provide to us may be accurate or inaccurate, we have no obligation to verify or intervene to correct your information (if not requested by you), you must be responsible for the accuracy, truthfulness, legality related to the information you have provided.

3.3. If you log in to become a user of our Services/Platform through using your social network account (“Social Network Account”), link your account with your social network account or use any social network features, we have the right to access information about you that you have voluntarily provided to your social network account provider subject to these providers’ policies, and we will manage, process and use this personal data in accordance with the provisions of this Policy at all times.

3.4. If you do not want us to collect the above personal information/data, you may opt out at any time by notifying us in writing, which means you will stop using the Service/Platform.

You may also withdraw consent, request deletion, restrict processing, object to processing, request provision of personal data, access or modify information you have provided to us in writing. However, note that refusing, restricting or revoking permission for us to collect, use or process your personal data may affect your benefits when using the Service/Platform.

4. COLLECTION OF OTHER DATA

4.1 As with most other websites and mobile applications, your device sends information which may include data about you that is recorded by a web server when you use our Service/Platform. This information typically includes but is not limited to IP address, computer/mobile device operating system, browser type, mobile device type, mobile device characteristics, unified device identifier (UDID) or mobile equipment identifier (MEID) of your mobile device, referring website/mobile application address (if any), the pages you have accessed on our website/mobile application and access times and sometimes “cookies” (which can be disabled using your browser options) to help the website/mobile application remember your last visit. If you are logged in, this information is associated with your personal account. The information is also included in anonymous statistics to help us understand how visitors use our website/mobile application.

4.2 Our mobile applications may collect precise information about the location of your mobile device using technologies such as GPS, Wi-Fi, etc. We collect, use, disclose and/or process this information for one or more purposes including but not limited to location-based services that you request or to deliver relevant content to you based on your location or to allow you to share your location to other users as part of the services provided by our mobile applications. For most mobile devices, you can withdraw your permission for us to acquire this location-based information through your device settings. If you have questions about how to disable your mobile device’s location services, please contact your mobile service provider or your device manufacturer.

4.3. As when you access our Service/Platform, when you view content and advertising and access other software/features on our Service/Platform or through the Service, information may be sent to us (including but not limited to, IP address, operating system, etc.); but, instead of page views, your device sends us information about content, advertising viewed or software installed.

5. COOKIES

As part of offering and providing customized and personalized services, Bizfly Cloud may use cookies to store and sometimes track information about you. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. Some features of Bizfly Cloud require you to accept cookies in order to work.

5.1. Sometimes we or our authorized service providers and advertising partners may use “cookies” or other features to allow us or third parties to collect or share information related to your use of our Service/Platform. These features will help us improve Service/Platform and help us provide, help us suggest new services and features, and/or allow us and our advertising partners to provide more relevant content to you. “Cookies” are identifiers stored on your computer or mobile device that store data about your computer or device, how and when the Service/Platform is used or accessed, by how many people and to track activities within our websites/mobile applications. We may link cookie information with personal data. Cookies also link to information about what content you have selected/used Service/Platform that you have viewed. This information is used to track your usage of services, to deliver content appropriate to your preferences or needs, to allow advertising service provider partners to provide advertising services through pages via the Internet and to perform data analysis and/or track Service usage.

5.2. You may refuse to use cookies by selecting the appropriate settings on your browser or device. However, please note that if you do this you may not be able to use the full functionality of our Service/Platform.

6. HOW DO WE USE THE INFORMATION YOU PROVIDE TO US?

6.1. We may collect, use, disclose and/or process your personal data for one or all of the following purposes:

To consider and/or process your application/transaction with us or your transactions or correspondence with third parties via the Service/Platform;
To manage, operate, provide and/or administer your use of and/or access to our Service/Platform (including your preferences, needs);
To respond to, process, deal with or complete a transaction and/or to respond to your requests for certain products and services and notify you about service issues and unusual account activities;
To enforce our Terms of Service, Policy, procedures, other agreements;
To protect personal safety and the rights, property or safety of others;
For identification, verification, legal assessment purposes or for customer identification;
To evaluate and make decisions relating to your credit profile and risk and eligibility for loans, pay later or credit products (if any);
To maintain and administer any software updates and/or other updates and support that may be required from time to time to ensure our Service/Platform runs smoothly;
To deal with or facilitate customer service, carry out your instructions, deal with or respond to any enquiries submitted by you or on your behalf;
To contact you via telephone, text messages and/or fax messages, zalo, email and/or mail or otherwise for the purpose of administering and/or managing your relationship with us or your use of our Service/Platform;
To conduct research, analysis and development activities (including but not limited to data analysis, surveys, product and service development and/or profiling), to analyze how you use our Service/Platform, to recommend products and/or services that are of interest to you, to improve our Services or products and/or to enhance your customer experience;
To allow audit and surveys and other activities, verify the size and composition of our target audience, and understand your experience with our Service/Platform usage;
For marketing and advertising purposes, in which case, to send you by various modes and methods of communication marketing and promotional information and materials relating to products and/or services (including, without limitation, products and/or services of third parties whom Bizfly Cloud may collaborate or tie up with) that Bizfly Cloud (and/or its affiliates or related companies) may be selling, marketing or promoting, whether such products or services;
To provide regular customer programs and partner and promotional offers, as well as Bizfly Cloud or affiliate partner marketing campaigns;
To comply with legal proceedings or to comply with or as required by any applicable law and the requirements of any regulatory authority or as we actually believe disclosure is necessary, including but not limited to, responding to regulatory disclosure requirements applicable to Bizfly Cloud or affiliated companies;
To produce statistics and research for reporting requirements and/or maintaining internal management or as required;
To carry out due diligence or other screening activities (including but not limited to background checks) in accordance with legal obligations or regulatory authority requirements or our risk control procedures, which may be required by law or which may have been put in place by us;
To audit our Services or Bizfly Cloud operations;
To prevent or investigate any actual or suspected fraudulent activities against our operations, fraud, unlawful activities, omissions or misconduct, whether relating to your use of our Service/Platform or any other matter arising from your relationship with us;
To respond to any actual or potential threats or claims asserted against Bizfly Cloud or other claims relating to violations of third party Content;
To store, backup (whether for disaster recovery or other purposes) your personal data;
To process and/or facilitate a business asset transaction or a potential business asset transaction, where such transaction involves Bizfly Cloud as a participant or only involves a Bizfly Cloud affiliated company as a participant or involves Bizfly Cloud and/or any one or more Bizfly Cloud affiliated companies as participant(s), and there may be other third party organizations who are participants in such transaction. A “business asset transaction” refers to the purchase, sale, lease, merger, amalgamation or any other acquisition, disposal or financing of an organization or a portion of an organization or of any of the business or assets of an organization;
Any other purposes that we notify you of at the time of obtaining your consent (collectively the “Purposes”)

6.2. Your agreement to provide personal information and use our services means that you have confirmed, permitted and agreed that we may access, store, process and disclose your Account information and Content if required to do so by law or pursuant to a court order or by any governmental or regulatory authority having jurisdiction over Bizfly Cloud or Bizfly Cloud affiliates, Bizfly Cloud affiliate partners or with legitimate reason Bizfly Cloud believes that access, retention or disclosure is necessary and legitimate to:

(a) Comply with legal process;

(b) Comply with requests from any governmental or regulatory authority having jurisdiction over Bizfly Cloud or related Bizfly Cloud affiliates, Bizfly Cloud affiliate partners;

(d) Respond to any claims that are actual or potential threats against Bizfly Cloud or related affiliates or other claims that any Content violates the rights of third parties;

(e) Respond to your customer service requests;

(f) Protect the rights, property or personal safety of Bizfly Cloud or related affiliates, users and/or the public.

7. HOW DOES BIZFLY CLOUD PROTECT AND STORE CUSTOMER INFORMATION?

7.1. We implement various security measures and always strive to ensure the safety of your personal data on our systems. Bizfly Cloud commits to ensuring security measures and personal data of customers can only be accessed by a limited number of employees with special access rights according to the scope of work in charge of our systems.

7.2. We will maintain personal data in compliance with regulations on protection of personal information confidentiality and/or other applicable laws. This means that we will destroy or remove identifying information from your personal data when we receive your request in accordance with applicable laws or when we have reasonable grounds to determine that (i) the retention of that personal data no longer serves the purpose of collecting that personal data; (ii) retention is no longer necessary for any legitimate purposes or business purposes and (iii) there are no other legitimate interests to continue retaining such personal data. If you stop using our website/mobile application, or your right to use our website/mobile application and/or Services is terminated or cancelled, we may continue to store, use and/or disclose your personal data in accordance with this Privacy Policy and our obligations under personal information confidentiality protection regulations. Subject to applicable law, we may securely destroy your personal data without prior notice to you.

7.3. We have the right to refuse to delete, destroy data in case your request does not comply with current regulations, or because we assess that request has unsafe purposes, may or risks affecting our services, or violates regulations and is requested by legal authorities.

8. DOES BIZFLY CLOUD DISCLOSE INFORMATION COLLECTED FROM VISITORS?

8.1 In the course of conducting our business, we will/may need to use, process, disclose and/or transfer your personal data to third party service providers, agents and/or our affiliates or related companies, and/or other third parties whether located in Vietnam or outside Vietnam (if any), for one or more of the above-stated purposes, and such disclosure will be made in accordance with applicable laws. Such third party service providers, agents and/or affiliates or related companies and/or other third parties would be processing your personal data either on our behalf or otherwise, for one or more of the above-stated purposes. We endeavor to ensure that third parties and our affiliates keep your personal data secure from unauthorized access, collection, use, disclosure, processing or similar risks and retain your personal data only for as long as your personal data is needed for the above-mentioned Purposes. Third parties include:

Our parent company, subsidiaries, affiliates and related companies;
Sellers or buyers with whom you have conducted transactions or interacted on the Service/Platform or in connection with your use of the Service for the Purposes stated above;
Other users of our Service/Platform for one or more of the purposes stated above;
Contractors, agents, service providers and other third parties we employ to assist or supplement our business operations. These parties include, but are not limited to those providing administrative or other services to us including but not limited to postal companies, telecommunications companies, advertising and communications partners, information technology companies, e-commerce organizations, and data centers;…
Regulatory authorities having jurisdiction over Bizfly Cloud or if permitted under Section 6.2;
A buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Bizfly Cloud’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal data held by Bizfly Cloud about our users is among the assets transferred; or to a counterparty in a business asset transaction that Bizfly Cloud or any of its affiliates or related companies is involved in; and
Third parties to whom we disclose information for one of the Purposes and such third parties in turn collect and process your personal data for one or more Purposes.

8.2. We may share information including statistical and demographic information about Users and their use of the Services with advertising service provider partners and programmers. We will also share statistical and demographic information about our users and their use of the Services with advertising partners and third parties providing advertising, re-advertising, and/or programming services.

8.3. For the avoidance of doubt, in the event that personal information confidentiality protection regulations or other applicable laws permit an organization such as us to collect, use or disclose your personal data without your consent, such permission granted by law shall continue to apply. Consistent with the above provisions and in accordance with applicable laws, we may use your personal data for recognized legal bases, including complying with our legal obligations, to perform our contract with you, to achieve our legitimate interests and our reasons for using such data outweigh any prejudice to your data protection rights or when necessary in connection with a legal claim.

8.4. Third parties may intercept or access personal data sent to or contained in the Service/Platform, technologies may malfunction or not work as anticipated, or someone might access, abuse or misuse information through no fault of ours. However we will implement reasonable security measures to protect your personal data in accordance with personal information confidentiality protection regulations; however absolute security cannot be guaranteed such as unauthorized disclosure arising from malicious hacking or third party attacks that are not our fault.

9. INFORMATION ABOUT CHILDREN

Parents or guardians of children please supervise and ensure personal information, be responsible for personal information of children under your guardianship provided to Bizfly Cloud.

When parents or guardians of children provide their and children’s data information to Bizfly Cloud means that parents or guardians have confirmed and agreed and comply with the contents and requirements of this Policy.

10. INFORMATION COLLECTED BY THIRD PARTIES

10.1. Our Service/Platform uses Google Analytics or other analytics tools (“Analytics Tools”, which use cookies, which are text files on your device, to help the Service/Platform analyze how users use our Service/Platform. The information generated by the cookie about your use of the Service/Platform (including your IP address) will be transmitted to and stored by the Tool Provider on servers in the country, abroad or at other authorized addresses. The Tool Provider will use this information to evaluate your use of our Service/Platform, compile reports on Service/Platform activity for Service/Platform operators and provide other services relating to Service/Platform activity and internet usage. The Tool Provider may also transfer this information to third parties where required to do so by law, or where such third parties process the information on the Tool Provider’s behalf. The Tool Provider will not associate your IP address with any other data held by them.

10.2. We, and third parties, may from time to time provide software application downloads for your use by the Service/Platform or through the Services. These applications may separately access, and allow a third party to view, your identifiable information such as your name, your user ID, your computer’s IP address or other information and any cookies that you may previously have installed or that were installed for you by a software application or website/mobile application. Additionally, these applications may ask you to provide additional information directly to third parties. Third party products or services provided through these applications are not owned or controlled by Bizfly Cloud. You should read the terms and other policies published by such third parties on their websites/mobile applications or elsewhere.

11. DISCLAIMER REGARDING SECURITY AND THIRD PARTY WEBSITES/MOBILE APPLICATIONS

11.1. We do not guarantee the security of personal data and/or other information that you provide on third party websites/mobile applications. We implement various security measures to maintain the safety of your personal data that we hold or control. Your personal data is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to our systems, and have been required to keep that personal data confidential. When you use or access your personal data, we ensure having secure servers. All personal data or personal information you provide will be encrypted into our databases to be accessed only as described above.

11.2. In order to provide you with added value, we may choose to link to various third-party websites/mobile applications or other applications or services. These linked sites have their own privacy policies and security measures that are independent and separate. Even if the third party is affiliated with us, we do not control these linked websites/mobile applications or other software, each of which has its own privacy protection and data collection methods, independent of us. Data collected by our co-marketing partners or by third-party websites/mobile applications or other software (even if provided on or through our Services/Platform) may not be accessible to or retained by us.

11.3. Therefore, we are not responsible or legally liable for the content, security measures (or lack thereof), and practices of these linked websites/mobile applications or other software. These linked websites/mobile applications or other software are provided solely for your convenience, and you access them at your own risk. However, we are responsible for protection within the scope of our Services/Platform.

12. WILL BIZFLY CLOUD TRANSFER YOUR INFORMATION ABROAD?

Your information and/or personal data is only used within the territory of Vietnam. Bizfly Cloud only transfers your personal data abroad when receiving requests from legal authorities in situations serving investigation purposes.

13.1. Withdrawing Consent, requesting restrictions, objecting to data processing, deleting data

You may withdraw your consent for permission, request restrictions, object to, delete data in the collection, processing, use and/or disclosure of your personal data that we hold or control by submitting a written request or sending an email with attached written request to us at email address: sales@bizflycloud.vn and we will process these requests according to the Privacy Policy as well as relevant legal regulations.

However, your withdrawal of permission, request for restrictions, objection to personal data processing, deletion of data may mean that we will not be able to continue providing Services to you and we may need to terminate the existing relationship between you and/or the contract you have with Us.

13.2. Request for Personal Data Provision

13.2.1. You have the right to request us to provide your Personal Data to yourself by submitting a written request or sending an email with attached written request to us at email address: sales@bizflycloud.vn. You also have the right to request us to provide your Personal Data to other organizations, individuals or of other organizations, individuals to you provided that you must provide valid authorization or other documents proving the data subject’s consent according to law regulations.

13.2.2. Your request is only considered valid and accepted for processing when it has all necessary information and uses the correct form as prescribed. When you request, we will send you the form to complete.

13.2.3. From time to time and at our assessment, we may charge you a reasonable fee to resolve and process your personal data provision request. If we charge a fee, we will notify you of the fee amount in each specific case, you have the right to continue requesting data provision or cancel this request.

13.2.4. In case your request is valid according to law regulations and falls under cases where we are permitted to provide data, we will notify you through appropriate contact methods about the time, place, form of personal data provision, costs (if any), methods, payment deadline (if any) and we will provide personal data according to this notice and other procedures according to law regulations.

13.2.5. We reserve the right to refuse to provide your personal data according to personal information confidentiality protection regulations, in cases where those laws require and/or allow an organization to refuse to provide personal data in such cases.

13.3. Request to Access or Edit Personal Data

13.3.1. If you have registered an account with us, you may personally access and/or edit your personal data that we hold or control through the Account Settings page on the Platform. If you have not registered an account with us, you may personally request to access and/or edit your personal data that we hold or control by submitting a written request or sending an email with attached written request to us at email address: sales@bizflycloud.vn

13.3.2 From time to time and at our assessment, we may charge you a reasonable fee to resolve and process your personal data provision request. If we charge a fee, we will notify you of the fee amount in each specific case, you have the right to continue requesting data provision or cancel this request.

13.3.3 We reserve the right to refuse to edit your personal data according to personal information confidentiality protection regulations, in cases where those laws require and/or allow an organization to refuse to edit personal data in such cases.
