Email Service Terms
These terms of use are established by Bizfly Cloud with the aim of ensuring that both customers and Bizfly Cloud avoid violations of current laws of the Socialist Republic of Vietnam while also helping customers protect their personal information and all their data while using Bizfly Cloud’s products and services. When customers create an account and use Bizfly Cloud’s Business Email product and service (hereinafter referred to as the Service), it means that customers have fully agreed and accepted the terms of use that Bizfly Cloud has set forth.
1. Customer account, password and security
- Customers must maintain the confidentiality of their password and account.
- Customers must be responsible for all activities related to Service usage occurring in their account (including content exchanged from their account or any content uploaded or sent through their account), except when third parties access the customer’s account due to Bizfly Cloud’s negligence.
Customers must notify Bizfly Cloud immediately if they notice unauthorized use of their account or any other security breach. If a third party accesses the customer’s account without permission, we will make efforts to block unauthorized access and restore control of the customer’s account.
2. Limitations on email storage, file storage, outgoing emails and other limitations
- Storage capacity per user may be limited depending on the subscription package purchased by the customer.
- Customers need to agree that Bizfly Cloud is not responsible or has no legal obligation regarding customers’ voluntary deletion or failure to backup emails, files, or information such as contacts, other personal information stored in the account.
2.1. Limitations on email storage, file storage, outgoing emails and other limitations
- These limits apply to each email account. If exceeded, the account will be temporarily blocked from sending new emails. Sending will be restored after the system reset cycle.
- During this time, the account can still receive new emails normally.

2.2. Email receiving limitations
- These limits apply to each email account. If exceeded, the account will be temporarily blocked from receiving new emails. Emails sent during the blocked period will be returned to the sender as bounce mail, and the sender’s system may resend later. As this depends on the sender, Bizfly Cloud does not guarantee the complete receipt of these emails.

2.3. Bandwidth limitations
- These limits apply to each email account. If exceeded, the account will be temporarily locked, unable to log in, until after the system reset time.

3. Customer regulations

Customers will not use the Service for any illegal purposes or purposes prohibited under these Terms.

Customers agree to comply with all applicable laws and regulations of the Constitution and Laws of the Socialist Republic of Vietnam and not engage in the following behaviors:

Using the Service to send surveys, marketing emails, junk mail, spam; to send duplicate content to large numbers of recipients; sending unwanted content without recipient consent (whether commercial or otherwise).

Defaming, abusing, harassing, stalking, threatening, or violating the legal rights (such as privacy rights) of others.

Publishing, distributing, or disseminating any inappropriate, defamatory, infringing, obscene, indecent, or illegal materials or information.

Collecting information about others, including email addresses, without their consent.

Creating false identities to mislead others about the identity of the sender or the origin of the email.

Using, downloading, copying, or providing (with or without charge) any data of other users to any individual or organization.

Intentionally transmitting or uploading any material containing viruses, malware, or any other harmful programs.

Transmitting or uploading any material containing software or materials protected by intellectual property laws, or any other applicable privacy rights laws unless you own or control those materials or have received all necessary consents.

Attempting unauthorized access to other users’ accounts through password mining or any other means.

Violating any applicable laws or regulations regarding the transmission of data or software from Vietnam to outside territories.

Interfering with other members’ use and experience of the Service.

Bizfly Cloud is not permitted and has no obligation to monitor or store the content of any user session.
4. Disclaimer
Bizfly Cloud will not be responsible for:

Unauthorized access to customer accounts or changes to transmission or data; or changes to any materials or data sent/received or not sent/received; or any transactions made through the Service originating from the customer.

Any threatening, defamatory, offensive, illegal content or behavior of any other party, any other rights infringement, including intellectual property rights;

Any content sent or attached by third parties using the Service.
Bizfly Cloud will not be legally responsible for any direct or indirect damages affecting service interruption, data loss, customer profits including:
- Factors arising from customer’s use of the service;
- Objective factors due to natural disasters, terrorism, fire, etc. affecting Bizfly Cloud’s service provision to customers.
5. Termination
Bizfly Cloud may terminate Customer’s access to any or all Services and all related services immediately if Customer fails to comply with these Terms or as required by Law.
Bizfly Cloud may also suspend or delete customer’s account if Customer fails to fulfill payment obligations according to service usage commitment - determined as failure to renew after the paid registration period expires.
Upon Service termination, Customer’s right to use the Service will terminate immediately.
Bizfly Cloud will have no obligation to maintain any content in Customer’s account or forward any unread or unsent emails to Customer or any third party.
6. Refunds
At its discretion, Bizfly Cloud may choose to refund prepaid Service fees. However, Bizfly Cloud will have no obligation to refund any fees in cases where:
- Customer wants to stop using all or part of the Service; or
- Customer’s Service is suspended/cancelled by Bizfly Cloud due to non-compliance with these Terms.
7. No spam
Bizfly Cloud has the right to immediately suspend any account that is believed to be transmitting or sending spam/unsolicited bulk emails.
8. Changes to service terms
Bizfly Cloud has the right to change these Terms or policies related to Service use at any time and notify Customers by posting the updated version of these Terms on the website. Customers are responsible for regularly reviewing these Terms to check for updates. Continued use of the Service after any changes indicates customer’s agreement to those changes.
