Terms of Use

These terms of use are established by Bizfly Cloud with the aim of ensuring that both customers and Bizfly Cloud avoid violations of current laws of the Socialist Republic of Vietnam while also helping customers protect their personal information and all their data while using Bizfly Cloud’s products and services. When customers create an account and use Bizfly Cloud’s products and services, it means that customers have fully agreed to and accepted the terms of use that Bizfly Cloud has set forth.

1. Bizfly Cloud’s Responsibilities

  • Bizfly Cloud ensures to provide services as committed in the “Service Level Agreement”, and implement the “Privacy Policy” as published on Bizfly Cloud’s official websites.

  • Bizfly Cloud is not responsible for cases where customers violate the unacceptable forms of use specified in section 3 of these terms.

  • Bizfly Cloud has no obligation to monitor, control, or log activities related to: customer accounts, customer product-service management activities, activities occurring inside customers’ servers and applications.

  • Bizfly Cloud does not support intervention, modification, development of customer website source code or checking compatibility issues with server configurations.

  • Bizfly Cloud does not support customer website content management operations

  • Bizfly Cloud ensures to receive all requests from customers through:

  • Bizfly Cloud is responsible for notifying customers via registered email and phone number when detecting incidents, abnormal activities, or information security risks from customers’ accounts, servers, and services in use.

Bizfly Cloud is responsible for ensuring information security for customer assets, including:

  • Personal information (Name, email, phone number, etc.), payment information of customers stored on Bizfly Cloud’s system.
  • Access information to customer resources stored (if any), transmitted on Bizfly Cloud’s system.

2. Customer Responsibilities

  • Absolutely comply with the Constitution and Laws of the Socialist Republic of Vietnam.

  • Customers must take full responsibility if they violate the unacceptable forms of use in section 3 of these terms.

  • Customers must provide complete and accurate contact information including: full name, address, email, phone number. When necessary (according to legal requirements depending on service type), customers must provide related documents as requested by Bizfly Cloud (copy of ID card or other documents). In case customers transfer/add management rights/ownership rights of customer accounts/product-service packages in use, customers need to ensure updated complete and accurate contact information in Bizfly Cloud’s management system.

  • Customers need to ensure the maintainability of contact for the email address and phone number registered on Bizfly Cloud’s system.

  • Customers using services must commit to truthfully reflect on Bizfly Cloud’s product-service quality on all media, websites, forums…, and all reflections must be accompanied by authentic evidence. Bizfly Cloud has the right to unilaterally terminate the contract if detecting inauthentic reflections that are offensive and defamatory, negatively affecting the provider’s reputation.

Customers are responsible for their assets, including:

  • Customers need to keep safe their identification information, passwords or other confidential information related to their account. Immediately notify Bizfly Cloud through the reception channels in section 1 when detecting unauthorized access forms using customer accounts, including loss, theft or disclosure of password information and other security information.

  • Customers must be responsible for ensuring the security of their service access devices including the use of personal security software such as antivirus software, firewalls.

  • Customers are responsible for ensuring information security for their servers or services installed on their servers. Immediately notify Bizfly Cloud through the reception channels in section 1 when detecting information security issues occurring with their servers or services installed on their servers.

  • Customers are responsible for maintaining and preserving data on their servers.

3. Unacceptable Forms of Use

  • Storing documents, spreading information, using or storing harmful programs such as viruses, worms, trojans on Bizfly Cloud’s server system.

  • Using services provided by Bizfly Cloud to attack, unauthorized access, control block data of other users’/providers’ websites or servers.

  • Interfering with changes to the control system, resource monitoring and log files affecting Bizfly Cloud’s management and operation process.

  • Using source code that overloads the system or excessively uses resources according to service package limits.

  • Sending emails in any form for destructive purposes or spreading mail, including programs sending mail exceeding the specified quantity (100 emails/hour).

3.2. Content violations:

Customers are not allowed to store, distribute information or documents that violate the laws of the Socialist Republic of Vietnam and international regulations applied in Vietnam including:

  • Propaganda, criticism of a reactionary nature

  • Instructions for using military equipment

  • Using uncultured language, violating Vietnamese traditional moral and cultural standards

  • Pornographic nature, promoting depraved lifestyle

  • Violating patents, trademarks, design rights, copyright or any intellectual property rights or rights of any individual

  • Data that is illegal, threatening, deceptive…. or other prohibited forms

  • Data constituting or encouraging forms of crime

  • Disclosure of trade secrets, or personal information, secrets, proprietary information of others

3.3. Security violations:

Customers are not allowed to perform illegal, abusive, or irresponsible acts including:

  • Unauthorized access, use of data, systems or networks including any probing, scanning, testing network system vulnerabilities, violating security measures and authentication without the consent of the network system owner (including customers accessing the Web and customers using products-services at Bizfly Cloud)

  • Monitoring data or traffic on any network or system without permission from the owner of the system or network

  • Using Internet accounts or computers without authorization from the owner such as password scanning, tricking others to provide passwords, stealing passwords, scanning security vulnerabilities, login ports

  • Any form of TCP-IP spoofing or any email header in an email

4. Payment and fee refund

4.1. Payment:

Customers are responsible for full and timely payment of costs incurred when using Bizfly Cloud services. We will contact customers at the following times:

  • When the system issues an invoice (notification via email)

  • When the invoice payment deadline expires and service is suspended (3 working days after invoice issuance) (notification via phone, email)

When receiving notification requesting payment for usage costs, customers need to pay full costs except in cases where customer service may be interrupted or lost when service expires.

4.2. Fee refund:

Bizfly Cloud will refund costs in cases:

  • We no longer provide services that customers have paid for.

Bizfly Cloud will not refund costs in cases:

  • Errors occurring when using services not attributable to Bizfly Cloud.
  • Customer violates terms of use.
  • Customer’s service is suspended or deleted.

5. Service Suspension and Deletion

5.1. Service suspension:

Bizfly Cloud will suspend service in the following cases:

  • Customer has overdue service invoice.

  • Customer violates forms specified in section 3 of these terms.

  • Customer declares incorrect information (name, phone number…) to attempt fraud in use or payment.

  • Accounts showing abnormal signs such as: one person trying multiple accounts, multiple accounts verified with same phone number, similar accounts.

  • Cases arising as specified by Bizfly Cloud.

When customer service is suspended:

  • Service resources are in inactive state, customer cannot use resources.
  • Service Dashboard is locked from new creation and resource adjustment functions.

5.2. Service deletion:

Bizfly Cloud will delete service in the following cases:

  • After 7 working days from payment due date.

  • Customer violates forms specified in section 3 of these terms.

  • Customer declares incorrect information (name, phone number…) to attempt fraud in use or payment.

  • Accounts showing abnormal signs such as: one person trying multiple accounts, multiple accounts verified with same phone number, similar accounts with high frequency.

  • Cases arising as specified by Bizfly Cloud.

When customer service is deleted:

  • Service resources are permanently deleted from the system.
  • Personal information, balance amount, invoices and payment history are retained on the system to serve Bizfly Cloud’s analysis, statistics and customer care activities.

6. Data backup and recovery

Virtual server service packages by default do not include data backup service, therefore customers please contact Bizfly Cloud’s customer support team for guidance on performing data backup directly on the server or using additional data backup service package if needed.

Bizfly Cloud is not responsible for incidents occurring to data backups due to objective causes such as terrorism, natural disasters, fire, etc.

Backup will not be provided for accounts that have been suspended or permanently deleted service for any reason unless otherwise agreed in writing by both parties.

Bizfly Cloud is only responsible for full data recovery (entire hard drive, email folder, …) or providing backup for customers to handle themselves but does not perform individual file recovery at customer request.

7. Compensation

In case Bizfly Cloud is sued for customer actions, customer must pay all fees including loss fees, court fees.

8. Changes to Terms of Use

Bizfly Cloud may change, modify, supplement or replace content of terms of use at any time to comply with laws of the Socialist Republic of Vietnam. All changes take effect from when published on website support.bizflycloud.vn
